By accessing or using our website, services, applications, products and content (that include but are not limited to the Platform) (collectively, the “Services”), you acknowledge that you have read this policy and that you understand your rights in relation to your information and how we will collect, use and process it. If you do not agree with this policy in general or any part of it, you should not use our Services.

By using Pecan, you are agreeing to be bound by these Terms between you and Pecan Team (herein after “we”, “our” and “us”). You also agree that we may collect, use and share your information in accordance with this Privacy Policy, as revised from time to time. In addition, your use of Pecan signifies that you agree with the terms of this Privacy Policy. If you do not agree with the terms of this Privacy Policy, do not use Pecan.

This Privacy Policy is incorporated into and forms part of the Pecan Terms of Service that you have agreed to in order to use Pecan. Any terms used in this Privacy Policy will have the same meaning as the equivalent defined terms in the Pecan Terms of Service unless otherwise defined in this Privacy Policy or the context requires otherwise. Unless otherwise specified in this Privacy Policy, these terms in the Pecan Terms of Service shall also be applicable in this Privacy Policy.

Any information that is collected is subject to the Privacy Policy in effect at the time such information is collected. We may, however, modify and revise our Privacy Policy from time to time. If we make any change to this policy, which we deem to be material changes, we will (where reasonably practicable) notify you of such changes by posting them on our website, through our services or by sending you an email or other notification, and we will indicate when such changes will become effective. By continuing to access or use our services after the changes become effective, with or without notification, you are agreeing to be bound by the revised policy.

Pecan may link you to social media or other features or services (including websites, plug-ins and widgets) provided by a third party. Please note that this Privacy Policy doesn’t apply to the information collected by any third-party websites, services or applications that can be accessed through our services, and does not apply to the information collected by other companies and organizations who advertise their services on Pecan. We bear no liability for any third party use of any information provided by you to them.

What Information Do We Collect

We collect two types of data from you: personal information (“Personal Information”) and non-Personal Information. Personal Information is any information that may allow you to be identified in a reasonable manner (e.g., email address or name). In contrast, non-Personal Information can be defined as any information that is not associated with an identified or identifiable natural person. This may include your aggregate usage information and technical information transmitted by your device (e.g., the device you use, the type of browser and operating system your device uses, language preferences, access times, etc.). This section explains how and when we collect these types of data from you.

Personal Information

Registration Information. During your registration for the Services, we will ask you to provide certain Personal Information, including your name, email address, mobile phone number, social media identifiers, and your contact details.

Payment Information. When you decide to make a purchase or withdraw funds from our Services, you will need to provide us with your billing information. The information you need to submit depends on the billing method you choose. For example, if you pay by credit card, we will collect your card information.

Device Identifiers and Device Data. When you visit or access the Services, we also collect your IP address, UDID, your precise geographic location, and other information transmitted by your device, including, but not limited to, the type of browser and operating system your device uses.

Login History and Usage Information. To enhance the functionality of the Services and provide you with a better user experience, we collect technical information transmitted by your device when you use the Services, including information about your behavior and use of the Services.

Communication Information. We collect the personal information you provide to us when you send us an email or contact us through support in our Services. This may include your name, email address, and any other information you choose to provide.

Non-Personal Information

In any of the above cases, as well as to provide and improve our Services, aggregate statistics, marketing purposes and conduct business and marketing analysis, and enhance your experience with the Services, we process, use or share non-personal information, aggregate information, or personal information in non-human-readable form (for example, anonymous or aggregated information about how our user community interacts with the Services).

We may anonymize or de-identify information collected through the Services or by other means so that the information itself does not personally identify you. Our use and disclosure of such aggregated or de-identified information is not subject to any restrictions in this Policy, and we may disclose it to others for any purpose, such as advertising or marketing purposes, without restriction.

If we combine personal information with anonymous information, the combined information will be treated as personal information for as long as the information remains combined.

How we use information we collect

We will only use your Personal Information when the applicable laws allow us to. In general, we use your Personal Information for the following purposes:

Provision of services: to present Pecan Services and its contents to you, including any interactive features on Pecan Services, and to provide you with information, products or services that you allow us to; we also collect and use Personal Information to verify your eligibility and deliver prizes in connection with promotion activities and sweepstakes;

Improvement of services: to improve and personalize our services by presenting new services, information, recommendations, and feedback;

Customer management: to manage a registered user’s account, to provide customer support and notices to the registered user about his account or subscription, and notices about changes to Pecan Services or any other product or service we offer or provide through it;

Communication: to communicate and interact with you directly, for an example, we may send notifications regarding upcoming changes, promotion activities or improvements on Pecan Services;

Content review: to review pictures, images and contents posted or generated on Pecan Services to ensure that we comply with any applicable content regulations in any relevant jurisdiction;

Customization of content: to perform research and analysis about your use of, or interest in contents, products, advertising, or services available on Pecan Services in order to develop and display content tailored to your interests on our Website and App;

Performance Analysis: to determine whether users of Pecan Services are unique, or whether the same user is using Pecan Services on multiple occasions, and to monitor aggregate metrics such as total number of visitors, number of videos viewed, demographic patterns;

Functionality and security: to identify users not meeting the age limit, to diagnose or fix technology problems, and to detect, prevent, and respond to actual or potential fraud, illegal activities, or intellectual property infringement;

Compliance: to enforce our terms of use and to comply with our legal obligations;

Aggregation: to aggregate information we collect about you to which one or more purposes described above.

Cookie: We and our vendors and service providers use cookies and other similar technologies (e.g., web beacons, flash cookies, etc.) (“Cookies”) to automatically collect information, measure and analyze which web pages you click on and how you use the Platform, enhance your experience using the Platform and improve our services. Cookies are small files which, when placed on your device, enable the Platform to provide certain features and functionality. Web beacons are very small images or small pieces of data embedded in images, also known as “pixel tags” or “clear GIFs,” that can recognize Cookies, the time and date a page is viewed, a description of the page where the pixel tag is placed, and similar information from your computer or device. By using the Platform, you consent to our use of Cookies.

Additionally, We link your contact or subscriber information with your activity on our Platform across all your devices, using your email or other log-in or device information. We are not responsible for the privacy practices of these third parties, and the information practices of these third parties are not covered by this Privacy Policy.

You may be able to refuse or disable Cookies by adjusting your browser settings. Because each browser is different, please consult the instructions provided by your browser. Please note that you may need to take additional steps to refuse or disable certain types of Cookies. In addition, your opt-out selection is specific to the particular browser or device that you are using when you opt out, so you may need to opt-out separately for each of browser or device. If you choose to refuse, disable, or delete Cookies, some of the functionality of the Platform may no longer be available to you.

Note that we may process your Personal Information for more than one lawful ground depending on the specific purpose for which we use your Personal Information.

Why we collect device IDs

In addition to some of the specific uses of information we describe in this Privacy Policy, we may use device IDs information that we receive to:

• User Authentication and Security: “Pecan” uses Device IDs to uniquely identify a user's device, which can enhance security and help prevent unauthorized access. This is important when streaming sensitive or paid content to ensure that only authorized devices can access the stream.
• Personalization and User Experience: “Pecan” streaming app uses device IDs to personalize the user experience. By identifying the user's device, the app can remember user preferences, content history, and settings, making it more convenient and enjoyable for the user.
• Content Licensing and Copyright Protection: “Pecan” Collecting device IDs can help track the distribution of copyrighted content. This can be beneficial for content providers who want to monitor the distribution of their content and enforce copyright protections.
• Quality of Service: “Pecan” uses Device IDs to optimize the quality of the stream for a particular device. By knowing the device's capabilities, network conditions, and location, the app can adapt the stream quality to ensure a smoother and higher-quality viewing experience.
• Troubleshooting and Customer Support:“Pecan” users when encounter issues with the app, the device ID can help customer support teams identify and resolve problems more effectively. It can assist in troubleshooting by providing information about the user's device and its configuration.

How We Share Your Information

We will share your information with the following selected third parties: cloud storage providers to store the information you provide and for disaster recovery services, as well as for the performance of any contract we enter into with you; 

Analytics and search engine providers that assist us in the optimisation and improvement of the Platform; and IT service providers; 

Our data center and the servers of our host providers. 

We will also share your information with any member, subsidiary, parent, or affiliate of our corporate group, only for the purposes set out above, to assist in the improvement and optimisation of the Platform, in order to prevent illegal uses, increase user numbers, development, engineering and analysis of information or for our internal business purposes. 

We will share your information with law enforcement agencies, public authorities or other organizations if legally required to do so, or if such use is reasonably necessary to: comply with legal obligation, process or request; enforce our Terms of Service and other agreements, policies, and standards, including investigation of any potential violation thereof; detect, prevent or otherwise address security, fraud or technical issues; or protect the rights, property or safety of us, our users, a third party or the public as required or permitted by law (including exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction).

International Data Transfers

Your Personal Information may be processed by us, our trusted third party suppliers outside of the country (s) in which you reside, including in countries where data protection and privacy laws or regulations may be equivalent to, or as protective as, the data protection laws and regulations in your country. In accordance with applicable data protection and privacy laws and regulations, we will implement appropriate measures to ensure that your personal information remains protected and secure when it is transferred outside of your country to a jurisdiction that has a less adequate level of protection of personal data.  These measures include (where applicable) transferring pursuant to data transfer agreements implementing standard data protection clauses. 

We may also transfer your personal information outside of your country as permitted by applicable data protection and privacy laws and regulations.  Examples include where we need to transfer your personal information: (a) to perform a contract with you (or to take steps before the contract at your request); (b) perform a contract in your interests; or (c) in relation to legal claims.

Pecan may disclose your personal data in good faith for the following reasons:

Data Security

We take appropriate administrative, technical and physical security measures to safeguard your Personal Information from unauthorized access and disclosure. For example, only authorized employees are permitted to access Personal Information, and they may do so only for permitted business functions. In addition, we use encryption in the transmission of certain your Personal Information between your system and ours, and we use firewalls to help prevent unauthorized persons from gaining access to your Personal Information. Please be advised, however, that we cannot fully eliminate security risks associated with the storage and transmission of your Personal Information. You should use caution whenever submitting information through Pecan Services and take special care in deciding which information you provide us with.

You are responsible for maintaining the secrecy of your password and account information at all times.

Service Provider

We can hire third-party companies and individuals to provide convenience for our services, or ("Service Providers") to provide services on our behalf, provide service related services, or analyze how to use our services.

These third parties accessing your personal data are used to perform these tasks on our behalf and have an obligation not to disclose or use it for other purposes.

 Your Choices

You can set your browser to refuse all or some browser cookies or to alert you when cookies are being sent. Please note that your choice to disable cookies will be specific to the particular browser or device that you are using when you disable cookies, so you may need to separately disable cookies for each type of browser or device. If you disable or refuse cookies, please note that some parts of the Website may then be inaccessible or not function properly.

You can at any time request to opt out from allowing us to send you push notifications by adjusting the permissions in your mobile device.

You can switch off GPS location, Microphone, Camera or other similar functions on your mobile device if you do not wish to share them. You can also hide your location, videos uploaded, recent active time and other information by adjusting “Privacy” setting.

You can choose not to provide us with Personal Information, but that may result in you being unable to use certain features of Pecan Services because such information may be required for you to register as a user, purchase Paid Services, participate in a promotion, survey, sweepstakes or make complaints.

You can make changes to your information, including accessing your information, correcting or updating your information or deleting your information by editing your profile in the App. 

Your rights 

Depending on the applicable laws and regulations in the area where you live, you may have some or all of the following rights: Access and update certain personal information you provided to us by logging into your Pecan account and using the features it provides; Request to view the data stored in your Pecan account for each Pecan service you use; Correct and delete personal information stored on Pecan services; or You can use the platform settings function or independently set or change the mobile advertising identifier in your mobile device or limit ad tracking through the privacy settings of your mobile device.

Children

The Services are not directed at children under the age of consent (namely, below the age where consent must be given or authorized by the holder of parental responsibility over the child, as required under the applicable law in the jurisdiction you reside in ( “Age of Consent”)). If you are under the Age of Consent you may use the Services only if consent is given or authorized by the holder of parental responsibility.

If Company learns that Personal Information of persons under the Age of Consent has been collected on or through the Services without parental or guardian consent, Company will take appropriate steps to delete this information unless it is needed to comply with any legal or statutory obligation.

Retention of Your information

As long as you have your account, we will keep your personal and other information. 

You can request to delete your account at any time through the application message > service or email. After appropriate review, you may delete information that is no longer required for regulatory, tax, insurance, litigation, or other legal reasons. For example, if needed, you can keep your device and data for a reasonable period of time. This information may be stored for security, safety, fraud prevention and investigation, and development purposes. In some cases, you may not be able to cancel the account (such as balances or unresolved charges or complaints). If the unblocking issue is resolved, please follow the instructions above to delete the account. 

For safety, security, and fraud prevention, you may need to store certain information. For example, if your account is closed due to bad behavior or security incidents, you can save account-specific information to prevent users from creating new money in the future.

Changes and Updates to This Privacy Policy

We may modify or revise our privacy policy from time to time. Although we may attempt to notify you when major changes are made to this privacy policy, you are expected to periodically review the most up-to-date version found at Pecan Services so you are aware of any changes, as they are binding on you.

If we change anything in our privacy policy, the date of change will be reflected in the "last updated date". By continuing to access or use the Services after those changes become effective, you agree to be bound by the revised Privacy Policy.
